Terms of Service — Invitly

Welcome to Invitly. By using our service, you agree to these Terms of Service.

1. Acceptance of Terms

By accessing or using our platform, you agree to be bound by these terms.

2. Description of Service

Invitly is an event-management platform. The service lets you create hosted event landing pages, design and embed branded "Add to Calendar" buttons and widgets, generate per-provider calendar links, publish calendar-feed (.ics) subscriptions for groups of events, and view aggregate engagement analytics for the events you create. Invitly is offered through Free, Entry, and Pro subscription tiers with differing usage limits and features. We reserve the right to modify, add, or discontinue features or the service at any time.

3. User Conduct and Platform Security

You agree not to use the service for any unlawful purposes, to distribute spam, or host malicious content. Furthermore, you explicitly agree not to use automated scripts, bots, or web scrapers to extract data from Invitly. Using platform data, including public event pages, to train Artificial Intelligence (AI) or Machine Learning models is strictly prohibited without our prior written authorization. Invitly uses passwordless sign-in via single-use email codes; you are responsible for maintaining control of the email inbox associated with your account and for all activity that occurs under your account.

4. Limitation of Liability

Invitly is provided 'as is' without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. To the maximum extent permitted by law, Invitly's total aggregate liability for any claim arising from or relating to the service shall not exceed the greater of the amounts you paid to Invitly in the twelve (12) months preceding the claim or fifty US dollars (USD $50).

5. Subscriptions, Billing, and Refunds

Invitly offers Free, Entry, and Pro subscription tiers. Because we provide a comprehensive Free Plan that allows you to fully evaluate our platform's capabilities risk-free, we maintain a strict no-refund policy for paid subscriptions. Paid subscriptions are billed in advance. You may cancel at any time, but we do not provide refunds or credits for partial billing periods. By upgrading to a paid tier, you acknowledge that you have had sufficient opportunity to test the service. Paid plans renew automatically: by upgrading, you authorize Invitly and its payment processor (PayPal or Wompi) to charge the then-current plan price to your selected payment method each month until you cancel. We may change subscription prices from time to time; we will give you reasonable advance notice (at least 30 days) by email or in-app before a price change affects your renewals, and you may cancel before the new price takes effect.

6. User-Generated Content

You retain all rights to the event details and content you create on Invitly. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute this content solely for the purpose of providing the service. You warrant that you have the necessary rights to all content you publish and that it does not infringe on any third-party intellectual property.

7. Guest and Attendee Data You Submit

If you enable RSVP collection or use Manual RSVP to add an attendee yourself, you are responsible for having a lawful basis to collect and share that person's name and email with us and, if you have connected a CRM integration (HubSpot, Slack, or Zapier), with that third-party provider. By using Manual RSVP, you confirm to us that you already have that attendee's consent. You act as the data controller for this attendee data; Invitly acts only as a data processor on your instructions. You are responsible for responding to any privacy request an attendee makes to you directly about their data.

8. Dispute Resolution and Governing Law

These Terms shall be governed by the laws of El Salvador, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the competent courts in El Salvador, and you waive any right to participate in a class-action lawsuit.

9. Eligibility and Age Requirements

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a paid subscription, and you represent that you have the legal capacity to enter into this agreement. The service is not directed to children under 13 (or under 16 where a higher minimum age for digital consent applies), and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact [email protected] and we will delete it.

10. Third-Party Trademarks

All third-party trademarks (including logos and icons) referenced by Invitly remain the property of their respective owners. Invitly's use of third-party trademarks does not indicate any relationship, sponsorship, or endorsement.
